2. Data collected by the FCMS
2.1 Data you share with us directly
We collect information submitted (for example, when you fill in a film submission form or when you join the newsletter) through the website interface or other (for example through our sales platform). This information may include:
- First and last name
- Email address
- Address, phone number
- A variety of information depending on the form: biography, submitted film descriptions, film distribution, etc…
- Photographs
- Content that you upload or download via the FCMS website
- Information you send to the FCMS by email or by phone (such as when you’re requesting information from the communications team).
2.2 Data collected automatically
When you visit the website, we automatically collect information. The data collected includes information about the type of device you used (computer or mobile device) as well as data about your interaction with our website, including the operating system, the type of browser, the make and model of the electronic device, the IP address, and data relating to the pages you’ve visited on the Website. The FCMS does not match this type of data to your identity.
2.3 Data stemming from analytical tools
When you access the Website, we collect certain data from tools such as Google Analytics. This data may include, for example, the country you are currently in, your age, your interests as well as the pages you have visited during your session. This data is not associated with you personally and is provided to us as aggregate data.
2.4 Data from social networks
When you interact with the Festival’s social networking sites or applications such as Facebook, Instagram, Twitter, YouTube, Vimeo or others, we collect information which is transmitted by these sites or applications. These sites or applications are also governed by their own policies regarding your personal data which may differ from our own guidelines but remain applicable.
3. How can you (member of the public) manage the data and information that is shared?
3.1 You are in control!
Part of the data that is collected by the FCMS is done through processes that can be modified directly from your browser. You can change your browser settings to disable elements such as first or third-party cookies.

3.2 Withdrawal of consent, data deletion and complaints
In certain situations, you may contact us to withdraw your consent (example: unsubscribe from our newsletter), request the deletion of personal information or gain access to your personal data held by us. If you are a European Union resident, depending on where you live, you have the right to file a complaint regarding the processing of your personal data with a data protection agent.
If you reside outside the European Union, the management of your personal information is governed by the laws and regulations applicable in Canada and it is the Canadian authorities who are to receive any complaint or claim regarding the processing of your personal data by the FCMS.
4. What do we do with the data collected?
4.1 To Communicate With You
We use your personal information only if you have provided it voluntarily and given your express or implied consent to receive communications from us.
4.2 To Improve the Website
Aggregated, anonymized data allow us to conduct statistical analyses to improve the performance of fcms.ca and enhance user experience.
4.3 Advertising and Retargeting
Some data may be used for advertising retargeting purposes, without identifying you personally.
4.4 Purpose Limitation
We use your information only for the purposes for which it was collected and in accordance with transparency requirements under Law 25
5. Who has access to this data?
We share your personal data only in the manner outlined on this page or when we have obtained your specific consent. This data may be shared with the following categories of people for the purposes mentioned in this document.
5.1 Employees
The data is only accessible to our directors and employees who need it for the purposes identified in section 4.
5.2 Service providers
Some of this data may be made available to our service providers. This is to enable us to serve customers more effectively. No data is sold, and we do not allow our suppliers to use this data for their own means. Our suppliers are contractually obliged to keep the data confidential and not to use it outside the limits of the mandate given to them by the FCMS.
5.3 Legal obligations
We may need to disclose personal data to third parties if the law permits us or requires us to do so, or at the request of a competent authority. We may disclose personal data in connection with legal proceedings to either protect our rights or those of our users.
6. Privacy Incidents
If an incident occurs involving personal information (loss, unauthorized access, breach):
- we will take immediate steps to reduce the risks
- we will keep an internal incident register
- if the incident presents a risk of serious harm, we will notify:
• the Commission d’accès à l’information (CAI)
• every affected individual
7. How is the data stored?
Personal data is retained until either we receive a request from you to destroy it or until we no longer need it for any of the purposes outlined on this page. The personal information that we collect is stored electronically on servers. These are operated by our service providers who are committed to using reasonable security measures to preserve the integrity and confidentiality of the data. Personal data collected about individuals outside of Canada is transferred to Canada.
7. Modification of the Guidelines
The FCMS’s guidelines regarding the gathering, processing, usage and sharing of personal information may be modified over time. If this happens, it is to adapt to new ways of doing in our field or to ensure that we are complying with new legal obligations.
